The commercial rules we work to. Written to be read rather than to be survived — if a clause here surprises you, it has failed at its job and we would like to know.

If a term here does not work for your operation, say so before you order rather than after. Most of these have been negotiated at some point.
The three that matter most
The photographs are the specification. If what arrives does not match the lot photographs we sent with your quote, it goes back on our truck at our cost.
You must disclose prior contents when you sell to us. Unknown is an acceptable answer. Undisclosed is not, and it voids the transaction.
Used containers are sold for the application discussed. Grade is matched to the use you tell us about. Using a container for something else is your decision and your risk.
1. Who you are contracting with
IBC Totes TX LLC, 3505 Montopolis Dr, Austin, TX 78744. These terms apply to all sales, purchases and services unless we have signed something else with you that says otherwise.
2. Quotes
Quotes are valid for 14 days and are subject to stock at the time of acceptance. Grade availability moves daily on a used-goods yard; where a specific grade sells out we will offer the nearest equivalent and re-price rather than substitute silently.
Prices published on this website are indicative bands intended to be useful, not offers. The written quote is the offer.
3. Grading and photographs
Every lot is graded against the standard published at /sizes/grades and photographed before dispatch. Those photographs form the description of the goods. Grading is a house standard and is not comparable with other sellers’ letters.
Cosmetic staining, haze and repaired welds within the stated grade are not defects. Structural defects, leaks and mis-grading are.
4. Freight and delivery
Freight is quoted separately and is an estimate until booked. Delivery dates are targets, not guarantees; we will tell you promptly when one is going to slip rather than letting it pass in silence.
You are responsible for telling us whether you can unload, and with what. A failed delivery caused by an absent forklift or an inaccessible site is chargeable at cost.
Risk passes on delivery. Title passes on payment in full.
5. Returns
Goods that do not match the lot photographs, that leak on first fill, or that are mis-graded may be returned within 14 days of delivery at our cost, for replacement or refund. Tell us before you fill the rest of the load.
Goods that match their description but turn out to be unsuitable for your application may be returned within 14 days in the condition supplied, subject to return freight and a restocking charge. Containers that have been filled, cut, modified or branded cannot be returned.
6. Prior contents — selling to us
When you sell containers to us you warrant that you have the right to sell them and that you have disclosed everything you know about their prior contents. “Unknown” is an entirely acceptable disclosure and is priced accordingly. A knowingly false or withheld disclosure voids the transaction, and you remain responsible for any disposal cost arising.
We do not accept containers that held listed hazardous waste or agricultural pesticides through our general intake. Those have dedicated routes and we will point you to them.
7. Suitability and use
Used containers are sold for the application you describe to us. We advise on grade selection in good faith and on the information you give us. Determining chemical compatibility, regulatory suitability and structural adequacy for your specific use remains yours.
No container sold as reconditioned or used carries current UN certification for the transport of regulated goods unless we have specifically supplied it as requalified with documentation.
8. Payment
First orders are prepaid or paid on collection. Established commercial accounts are net 30. Buy-back payments are made by ACH within five business days of the load being graded in, or as trade credit immediately at a premium.
9. Limitation of liability
Our liability for any claim is limited to the price paid for the goods or services giving rise to it. We are not liable for loss of product, loss of profit or consequential loss arising from container failure, save where such exclusion is not permitted by law. Nothing here limits liability for death or personal injury caused by our negligence, or for fraud.
10. Governing law
These terms are governed by the laws of the State of Texas, and the courts of Travis County have exclusive jurisdiction.
